By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.
We may update or modify these Terms of Service from time to time. Any changes will be effective upon posting on our website and will apply to users who access the service after the changes take effect.
We will make reasonable efforts to notify existing users of material changes by email or in-app notification. Continued use of the service after the changes are posted constitutes acceptance of the updated Terms.
If you do not agree with the changes, you may terminate your subscription or stop using the service in accordance with the cancellation provisions described in these Terms.
By using our service, you acknowledge that you have read and understood our Privacy Policy, and you agree to the collection, use, and storage of your personal data as described therein.
Your use of the service constitutes acceptance of the Privacy Policy, which is incorporated into these Terms of Service by reference.
To use our service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.
You may not share your account with others, and you must be at least 18 years old to create an account and use our service.
By subscribing to our service, you agree to pay the subscription fees specified at the time of purchase. Subscriptions may be billed on a recurring basis (monthly, yearly, or other intervals offered).
Your subscription will automatically renew at the end of each billing period unless you cancel prior to the renewal date. Renewal fees are charged at the current rate in effect at the time of renewal, and we will notify you of any price changes in advance where required by law.
You authorize us to charge your chosen payment method automatically for all applicable subscription fees. Failure to pay may result in suspension or termination of your subscription.
Cancellation:You can cancel by yourself from your settings page. Cancelling your subscription will prevent future renewal charges, but your access to the service will continue until the end of the current billing period, unless otherwise specified in our Refund Policy.
All fees are non-refundable, except as provided in our Refund Policy.
We offer a 14-day money-back guarantee for new customers. If you are not satisfied with your purchase within 14 days of your first subscription payment, you may request a full refund.
This guarantee applies once per person or organization. Refund requests made under different accounts, emails, or payment methods that reasonably appear to belong to the same individual or entity will be considered duplicate requests and will not be honored.
Attempts to circumvent this policy, including creating multiple accounts to obtain repeated refunds, may result in temporary or permanent account suspension.
While we aim to provide a reliable service, unjustified refund requests outside this 14-day window are generally not granted, except in exceptional circumstances at our discretion.
Technical issues: If a recording fails due to a technical problem caused by our system, we may consider a refund or credit regardless of the 14-day period, as described in our Limitation of Liability section.
We value fairness and transparency. However, if a user submits a false, fraudulent, or abusive payment dispute or chargeback, we reserve the right to permanently suspend or refuse future access to our services.
This measure is taken only in cases where the dispute is found to be unjustified or abusive, and after appropriate verification.
Our service is provided as a technical tool that allows users to record live streams for personal or otherwise authorized purposes.
Users are solely responsible for ensuring that they have the necessary rights or permissions to record, store, or use any content.
Please do not record a streamer or any content where recording is not permitted by the creator or the platform.
Users are solely responsible for the content they record or store using our service. You may not use the service to record, store, or distribute content that violates laws, third-party rights, or platform terms of service, including but not limited to copyrighted material, pornography, hate speech, or other illegal content.
We do not monitor or control user content, and we are not responsible for any illegal content recorded or stored using our service.
Users may not record streams that are private, unlisted, password-protected, or intended for a limited audience, unless they have explicit authorization from the content owner.
Recording such content without consent may violate privacy or copyright laws.
To ensure stable operation for all users, we may impose limits on recording duration, number of concurrent recordings or number of downloads per account.
Excessive usage, such as repeatedly downloading the same recording in a manner that negatively impacts service performance or infrastructure, may result in temporary throttling, reduced download speeds, or account suspension.
These measures are applied only to protect service quality for all users and in accordance with these Terms.
We reserve the right to suspend or terminate access to our services in cases of fraud, abuse, violation of our Terms, or any activity that threatens the security, integrity, or proper functioning of the service.
We do not monitor or pre-screen the recordings created through our service and cannot be held responsible for any unauthorized use or infringement of third-party rights.
The user remains fully liable for the content they record or share using our service.
The recordings created using our service are intended solely for personal or authorized use.
Users may not publicly distribute, share, or monetize recorded content without the consent of the original creator or rights holder.
All content, features, and functionality of our service, including but not limited to software, text, graphics, logos, icons, images, audio clips, video clips, data compilations, and the design, selection, and arrangement thereof, are owned by us, our licensors, or other providers of such material and are protected by French and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the service for your personal or internal business purposes, subject to these Terms.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our service content, except as necessary to use the service for its intended purpose or as expressly permitted in these Terms.
If you believe that material recorded or hosted through our service infringes your copyright or other rights, you may notify us by email at legal@vodist.com.

Upon receiving a valid notification, we will promptly investigate and, if appropriate, remove or disable access to the content in question.
Recordings and associated data are stored on our servers for the duration of your active subscription. We may retain your recordings for a reasonable period after your subscription ends, but we are not obligated to do so.
Upon termination or expiration of your subscription, we reserve the right to delete your recordings and account data after a grace period. It is your responsibility to download and back up any recordings you wish to keep before your subscription ends.
We may also delete recordings that have been stored for an extended period or that exceed storage limits, in accordance with our fair use policy and storage capacity constraints.
We strive to provide a reliable, high-quality recording service. However, due to the nature of live streaming, we cannot guarantee that recordings will always be completed or available under all circumstances.
Factors such as network instability, third-party platform restrictions, server issues, or other unforeseen technical problems may occasionally prevent successful recordings or cause service interruptions.
Please note that recordings may not capture the very beginning of a stream, and a short delay at the start (typically a few minutes) may occur even when the recording completes successfully.
While we make reasonable efforts to maintain service continuity and resolve technical issues, we cannot be held responsible for any data loss, recording failure, or service interruptions resulting from these limitations.
We also cannot guarantee that the service will be continuously available or maintained indefinitely. We reserve the right to modify, suspend, or permanently discontinue the service at any time, for any reason, without prior notice.
In the event of service discontinuation, users are not entitled to any refund, compensation, or damages, except as provided in our Refund Policy.
It is the user's responsibility to download or back up any recordings or data before the service is modified or discontinued.
Our service may interact with third-party platforms (such as Twitch, etc.) through their public APIs or web interfaces.
Users are responsible for complying with the terms of use and API policies of these platforms.
Any violation of such third-party rules is the sole responsibility of the user.
We are not affiliated with or endorsed by these platforms, and their names and logos remain the property of their respective owners.
The service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant that the service will meet your requirements or expectations.
We make no warranties about the accuracy, reliability, completeness, or timeliness of recordings, content, or any information obtained through the service.
No advice or information, whether oral or written, obtained by you from us or through the service will create any warranty not expressly stated in these Terms.
While we make reasonable efforts to maintain a reliable and high-quality service, we cannot guarantee uninterrupted operation or the successful completion of every recording.
Due to technical limitations, recordings may not capture the very beginning of a stream, and partial recordings may occur.
To the fullest extent permitted by law, our total liability for any claim related to the use of the service shall not exceed the amount of subscription fees paid by the user during the previous month.
We shall not be liable for indirect, consequential, incidental, special or punitive damages, including loss of data or missed recordings.
You agree to defend, indemnify, and hold harmless VODist, its affiliates, and their respective directors, officers, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
This indemnification obligation will survive the termination of these Terms and your use of the service.
We shall not be liable for any failure or delay in performance of our obligations under these Terms due to extraordinary, unforeseeable, and unavoidable circumstances beyond our control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
These Terms are governed by French law.
In the event of a dispute, the competent court shall be that of the user's place of residence, in accordance with French consumer protection rules.
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section will be null and void.
We may assign or transfer our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of the remaining provisions. The invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the service, constitute the entire agreement between you and VODist concerning the use of the service.
These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and VODist with respect to the service.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.
All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, and dispute resolution provisions.
